FanKuha Terms of Service
These Terms govern access to FanKuha’s private founding-artist pilot, including artist accounts, public fan signup pages, QR tools, communications, and fan preference features.
1. Acceptance and pilot status
By creating an artist account, accessing an invited artist dashboard, or submitting a fan form, you agree to these Terms and acknowledge the Privacy Policy. Artist signup requires explicit acceptance of the current policy versions.
FanKuha is a limited, invitation-only pilot. Features may change, pause, or be withdrawn while privacy, provider, support, and compliance processes are validated.
2. Eligibility and accounts
Artist account holders must be at least 18, capable of entering a binding agreement, and authorized to act for the artist or organization represented. Account credentials and private invitation links must be protected and may not be shared.
Fans do not create passwords or general FanKuha accounts. Fan signup and secure update links are artist-specific.
3. Artist responsibilities
Artists must provide accurate profile and sender information, use fan data only for legitimate artist communications, honor fan choices, protect exports, and comply with laws and platform rules that apply to their messages and activities.
Artists may send only content they are authorized to send. They may not upload or send unlawful, deceptive, abusive, discriminatory, infringing, malicious, or misleading content; purchase or import unverified lists; evade suppressions; or contact people who have not provided the required permission.
4. Email and text communications
Email and SMS alerts may be sent only to eligible fans associated with the signed-in artist. FanKuha applies consent, unsubscribe, STOP, provider-suppression, duplicate-send, delivery-audit, and pilot-size safeguards, but artists remain responsible for message content and their legal obligations.
SMS consent is optional and is not a condition of purchase. Message frequency varies; message and data rates may apply. Recipients can reply STOP to opt out or HELP for help. Email recipients can use the unsubscribe link included in promotional messages.
5. Data and content
Artists retain ownership of their names, images, profile content, and other material they submit. Artists grant FanKuha a limited license to host, display, transform, and deliver that content as needed to provide the service.
Fan information may be accessed only by the relevant artist and authorized FanKuha systems or support personnel. Artists must not sell fan information, use it for unrelated profiling, or share it except with service providers acting on their instructions and subject to appropriate safeguards.
6. Service availability and third parties
FanKuha depends on third-party hosting, database, authentication, email, SMS, and network services. Delivery, inbox placement, carrier acceptance, QR scanning, uptime, and uninterrupted access are not guaranteed.
External artist links and third-party services are governed by their own terms and privacy practices. FanKuha is not responsible for content or services outside FanKuha.
7. Suspension and termination
FanKuha may suspend or terminate access to protect fans, artists, providers, or the service; respond to legal or provider requirements; investigate suspected abuse; or address violations of these Terms. Artists may request account closure through Support.
Closure does not automatically erase records that must be retained for consent, opt-out, suppression, fraud prevention, security, dispute, or legal purposes.
8. Disclaimers and responsibility limits
FanKuha is provided on an “as available” basis during the pilot. To the extent permitted by law, FanKuha disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or punitive damages, lost opportunities, lost profits, or loss of data arising from pilot use.
Nothing in these Terms excludes rights or liability that cannot legally be excluded. Final limitation, indemnity, dispute, and governing-law provisions require business and legal approval before expansion beyond the controlled pilot.
9. Changes and contact
We may update these Terms. The effective date and version appear at the top. Material changes will be presented to invited artists for acceptance when appropriate.
